In a significant stride towards social welfare and community rehabilitation, Srinagar has set a historic precedent by becoming the first district in Jammu and Kashmir (J&K) to implement the SMILE (Support for Marginalized Individuals for Livelihood and Enterprise) scheme under the aegis of GOMODAF India. This landmark initiative marks a transformative approach to addressing social challenges, focusing on marginalized individuals and fostering a more inclusive society.
What is SMILE scheme?
The SMILE scheme, introduced by the Government of India, aligns with human rights frameworks laid out by the National Human Rights Commission (NHRC) and the Supreme Court. This initiative focuses on two primary components:
- Comprehensive rehabilitation for transgender individuals.
- Rehabilitation for individuals engaged in begging.
In Srinagar, the scheme is spearheaded by the District Social Welfare Officer (DSW) in partnership with the NGO Inpallant Paryas, ensuring a collaborative approach to achieving its objectives.
Under the SMILE scheme, the rehabilitation process is designed to provide a holistic solution for marginalized individuals. The program’s key features include:
Shelter and Nutrition: Providing safe housing and nutritious meals to beneficiaries. Skill Development: Empowering individuals with vocational training in trades such as boutique work, tailoring, cutting, and bulb-making. Educational Opportunities: Ensuring that children previously involved in begging are enrolled in schools.
Dr. Bilal explained, “This is not just a place to sit, but a full-fledged rehabilitation home. We will focus on skill empowerment to integrate individuals into employment or enterprise.”
A notable aspect of the SMILE scheme is its focus on children. Dr. Bilal emphasized that children who were previously engaged in begging have been connected to educational institutions. “There is no better definition of a welfare state than ensuring these children receive an education and a chance at a brighter future,” he remarked.
The Launch of SMILE: A New Era for Rehabilitation
The implementation of the SMILE scheme was formally announced by Deputy Commissioner Srinagar, Dr. Bilal Mohiuddin, during the inauguration of a fully equipped rehabilitation home designed for marginalized individuals. Dr. Bilal described the initiative as a turning point for J&K, emphasizing Srinagar’s pioneering role in adopting such a comprehensive welfare model.
“This is the first time in J&K that this scheme is being implemented, and Srinagar is leading the way. It is a comprehensive scheme where we are actively involved in addressing the issue of begging,” said Dr. Bilal at the event.
The newly inaugurated rehabilitation center is designed with an initial capacity to accommodate 50 individuals, with future plans to scale up its capacity. Dr. Bilal elaborated on the center’s purpose, explaining, “Some people here complain about the lack of space in their homes. Now we have a proper rehabilitation center for them.”
The center offers not only a place to stay but also a supportive environment where individuals can access essential resources, skill development programs, and pathways to self-reliance.
From Criminalization to Rehabilitation: A Paradigm Shift
Historically, the issue of begging in J&K was addressed under the J&K Provincial Baggery Act of 1960, with its rules framed in 1964. The Act criminalized begging, and authorities often issued arrest orders for those involved in the practice. However, a significant legal development shifted this narrative.
The High Court of J&K, in a landmark 196-page judgment, struck down the Act, underscoring the responsibility of a welfare state to rehabilitate marginalized communities rather than criminalize them. Dr. Bilal highlighted the importance of this ruling, stating, “The court reinforced the idea that a community cannot be criminalized for their circumstances. Instead, the focus should be on rehabilitation.”
A Collaborative Effort for a Better Tomorrow
Expressing satisfaction with the progress made so far, Dr. Bilal commended the efforts of the district administration and the dedicated team behind the SMILE initiative. “Many media persons used to point out that we were only arresting individuals involved in begging. Now, we have an alternative—rehabilitation,” he said, highlighting the shift towards a more compassionate approach.
